Below are the terms and conditions when set up and pay your OneMusic invoices automatically on a monthly or annual basis. If you set up and pay by Automated Payments, then these terms will apply.
These terms and conditions outline Our commitment to you as an Automated Payment customer and your rights and responsibilities throughout the Automated Payment process.
1.1 When you have authorised Us to debit funds directly from your nominated bank account, We will arrange, through Our own financial institution, a debit to your nominated bank account any amount deemed payable by you on a monthly or annual basis, depending upon your declared option (Direct Debit Authority).
1.2 You will be provided with a copy of the Direct Debit Authority within 7 days of agreeing to it.
1.3 OneMusic will provide a written notice to you of the amount and date for each Automated Payment from your nominated bank account (Bank Account Direct Debit) no less than 10 days prior to the date of each Bank Account Direct Debit.
1.4 If your Bank Account Direct Debit is debited on a monthly basis, the following terms apply:
a. Your Bank Account Direct Debit amount will be debited from your nominated account at least 10 days after your monthly invoice is issued;
b. if OneMusic is notified that, in any given month, your Automated Payment has been dishonoured, then you must pay that monthly invoice prior to the due date using one of the alternative payment options offered by OneMusic. In such circumstances, your Direct Debit Request will, subject to clause 1.3(c) below, remain in place and continue for all subsequent months in accordance with its terms; and
c. if your Bank Account Direct Debit has been dishonoured on two consecutive months, OneMusic may terminate your Direct Debit Request arrangement.
1.5 If OneMusic has terminated your monthly Direct Debit Request under clause 1.4(c), OneMusic will issue a further tax invoice to you of any outstanding licence fees plus all remaining future monthly payments until the end of the then current Licence Year for payment within 30 days using one of the alternate payment options offered by OneMusic.
1.6 If your Bank Account Direct Debit is debited on an annual basis, the following terms apply:
a. Your Bank Account Direct Debit amount will be debited from your nominated account at least 10 days after your annual invoice is issued.
b. If OneMusic is notified that your annual Automated Payment has been dishonoured, then you must pay that annual invoice prior to the due date using one of the alternative payment options offered by OneMusic. In such circumstances, your Direct Debit Request will remain in place and continue for all subsequent years in accordance with its terms.
1.7 You can:
a. cancel or suspend the Bank Account Direct Debit; or
b. change or defer an individual Bank Account Direct Debit, at any time by giving OneMusic at least 3 business days’ notice at [email protected] or by telephoning OneMusic on 0800 232 173 during business hours.
2.1 When you arrange to have funds debited directly from your credit or debit card account, you authorise Us to arrange, through Our own financial arrangements, a debit to your nominated credit or debit card for any amount deemed payable by you (Automated Card Payments).
2.2 For Automated Card Payments, the full amount of each monthly or annual invoice will be automatically deducted from your nominated credit or debit card when your monthly or annual invoice is issued.
2.3 Where your Automated Card Payment is due to be deducted on a date that is a nonworking day or a national public holiday, We will deduct the payment amount on the next business day.
2.4 It is your responsibility to ensure that there are sufficient clear funds available in your credit card or debit card account to allow your Automated Card Payment to be made in accordance with these terms and conditions.
2.5 You may change your nominated credit or debit card account using your online account. For your change to take effect prior to your next Automated Card Payment, we must receive your request at least 3 business days’ notice before that payment is due to be debited.
2.6 You can:
a. cancel or suspend the Automated Card Payment; or
b. change or defer an individual Automated Card Payment,
at any time by giving OneMusic at least 3 business days’ notice at [email protected] or by telephoning OneMusic on 0800 232 173 during business hours.
2.7 If your Automated Card Payment is debited on a monthly basis, the following terms apply:
a. Your Automated Card Payment amount will be debited from your credit or debit card account when your monthly invoice is issued.
b. If OneMusic is notified that, in any given month, your Automated Card Payment has been dishonoured, then you may pay that monthly invoice prior to the due date using one of the alternative payment options offered by OneMusic. In such circumstances, your Automated Card Payment arrangement will, subject to c) below, remain in place and continue for all subsequent months in accordance with its terms.
c. If your Automated Card Payment has been dishonoured on two consecutive months, OneMusic may terminate your Automated Card Payment arrangement.
2.8 If OneMusic has terminated your monthly Automated Card Payment under clause 2.7(c), OneMusic will issue a further tax invoice to you for payment within 30 days of any outstanding licence fees plus all remaining future monthly payments until the end of the then current Licence Year using one of the alternate payment options offered by OneMusic.
2.9 If your Automated Card Payment is debited on an annual basis, the following terms apply:
a. Your Automated Card Payment amount will be debited from your credit or debit card account when your annual invoice is issued.
b. If OneMusic is notified that your annual Automated Card Payment has been dishonoured, then you may pay that annual invoice prior to the due date using one of the alternative payment options offered by OneMusic. In such circumstances, your Automated Card Payment arrangement will remain in place and continue for all subsequent years in accordance with its terms.
2.10 We will keep any information (including records and account details, but not your credit or debit card details) confidential and pursuant to OneMusic’s Privacy Policy which is available HERE or by email to [email protected]
2.11 We will only disclose information We have regarding your Automated Card Payment arrangement:
a. to the extent specifically required by law; or
b. for the purposes of this agreement (including disclosing information in connection with any query or claim).
2.12 If you believe that there has been an error in debiting your credit or debit card account, you should call OneMusic directly on 0800 800 663. Alternatively, You can contact Your Financial Institution for assistance.
2.13 If OneMusic concludes as a result of its investigations that your account has been incorrectly debited, OneMusic will respond to your query by arranging within a reasonable period for your Financial Institution to adjust your account (including interest and charges incurred by you) accordingly. We will also notify you in writing of the amount by which your account has been adjusted.
2.14 If OneMusic concludes as a result of our investigations that Your account has not been incorrectly debited, OneMusic will respond to Your query by providing You with reasons and any evidence for this finding in writing.
"We", "Us" and "Our" means OneMusic.
An “Automated Payment” is an automatic and regular debit payment initiated by OneMusic from your:
a. nominated bank account; or
b. credit or debit card (MasterCard and Visa only).
“Direct Debit Authority” means the authority you have provided to Us for Us to automatically debit your nominated bank account;
“Financial Institution” means the financial institution at which you hold the bank account or credit or debit card account that you have authorised OneMusic to debit; and
“Licence Year” has the meaning as set out in your OneMusic licence Terms of Use.
